How are the human rights to water and sanitation upheld without explicit legal recognition? Brazil shows that constitutional silence does not mean inaction. As HR2W Legal Expert Amael Notini explains, Brazil’s Constitution does not explicitly recognise the human rights to water and sanitation.

Yet courts have upheld these rights through the interpretation of related constitutional guarantees—including the rights to life, health, and a clean and healthy environment. At the same time, persistent challenges remain.
